These Terms & Conditions are a legally binding agreement between you (“User”, “you” or “your”) and Jetlink Investments PTY LTD (trading as “Calm Nights”, “we”, “us” or “our”). If you are entering into this agreement on behalf of a business or other legal entity, you represent that you have the authority to bind such entity to this agreement, in which case the terms “User”, “you” or “your” shall refer to such entity. If you do not have such authority, or if you do not agree with the terms of this agreement, you must not accept this agreement and may not access or use our services. By accessing and using our services, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions. These Terms and Conditions do not apply to the practices of companies that we do not own or control, or to individuals that we do not employ or manage.

Access to the Course Creator 360 Platform

All course materials are available through the Course Creator 360 Platform. An account will be automatically generated for you when you complete your purchase. You can access the platform and all course content using your computer, tablet or smartphone. While we strive to provide uninterrupted access, Calm Nights is unable to warrant the ongoing continuity of the Course Creator 360 platform. In the event that Course Creator 360 were to cease operations, we assure you that the 'Connected Sleep System' will be delivered via an alternative platform to ensure continued access to the course content.

Customers are advised to review the Course Creator 360 Terms & Conditions and Privacy Policy for a comprehensive understanding of the platform's usage terms. By accessing the course through Course Creator 360, you agree to comply with their policies in addition to our course-specific terms.

Lifetime Access

Lifetime access to any Calm Nights programs, courses, or materials is granted for the duration that Calm Nights Sleep Consultancy remains in operation. Should Calm Nights cease trading or otherwise discontinue its services, access to all associated content, platforms, and resources will no longer be available. While every effort will be made to maintain ongoing access, we do not guarantee lifetime availability in the event that the business is no longer active.

Access Issues and Responsibility to Notify

If you experience any difficulties accessing the platform or any of the program content, it is your responsibility to notify Calm Nights at the earliest possible time so that we can investigate and resolve the issue promptly. We are committed to ensuring a smooth and accessible experience for all clients, but we can only assist if we are made aware of the problem. Please note that failure to inform us of any access issues within a reasonable timeframe will result in the forfeiture of your eligibility for the 30-day money-back guarantee.

Right to Cancel Access

Calm Nights reserves the right to cancel or revoke your access to the 'Connected Sleep System' at any time, at its sole discretion. This may occur in circumstances including, but not limited to, breaches of our terms and conditions, inappropriate conduct within support communities, or misuse of program content. In such cases, access may be withdrawn without notice, and eligibility for a refund will be assessed based on the circumstances surrounding the cancellation.

Payment Methods and Currency

All payments for the 'Connected Sleep System' are processed securely through Stripe or PayPal and are charged immediately upon order submission. Prices are listed and charged in Australian Dollars (AUD). Access to the course will only be granted after successful payment processing; if a payment is declined, access will be withheld until a successful payment is made. The base price for the 'Connected Sleep System' is $97 AUD, with additional products or upgrades available for purchase at an extra cost. The final price will be clearly displayed before payment confirmation. By proceeding with the payment, you acknowledge and agree to these terms regarding payment methods and currency for the 'Connected Sleep System'.

If you follow the program as outlined and do not see an improvement in your child’s sleep, you may be eligible to apply for a refund. To qualify, you must have completed all the video content in the age-specific course relevant to your child within the 'Connected Sleep System'. Refund requests must be submitted within 30 days from the date of purchase. To request a refund, please email [email protected] with your purchase details and confirmation that the program was completed. If these conditions are met, we will process a refund for the full purchase price.

Refunds

All refunds will be processed within 7 business days to your original payment method, or another method may be arranged by negotiation if the original payment method is no longer available or appropriate.

It's important to understand that this course is not customised to reflect each customer's individual or family's unique needs. While we strive to offer comprehensive information, results may vary depending on your specific circumstances. Calm Nights cannot guarantee any specific outcomes from using this course. You will be primarily accountable for producing the results during the sleep training/shaping period, in this way Calm Nights seeks to educate, train and motivate you in order to help you manage your child’s sleep effectively.

By purchasing and using this course, you acknowledge that the content is general in nature and that individual results may differ.

Australian Law

Calm Nights is located in Queensland, Australia, and operates under the Australian Consumer Law.

Our services come with guarantees that cannot be excluded under the Australian Consumer Law. For major failures with the service, you are entitled:

● to cancel your service contract with us; and

● to a refund for the unused portion, or to compensation for its reduced value

● You are also entitled to be compensated for any other reasonably foreseeable loss or damage.

If the failure does not amount to a major failure, you are entitled to have problems with the service rectified in a reasonable time and, if this is not done, to cancel your contract and obtain a refund for the unused portion of the contract.

Intellectual Property & Personal Use

All digital products, including the 'Connected Sleep System', are the exclusive intellectual property of Calm Nights. By purchasing this course, customers are granted access to the content for personal use only, but do not acquire ownership rights to the intellectual property itself. Customers receive copies of the course materials solely for their individual or family's benefit in addressing sleep-related issues, but the underlying content, design, methodology, and all associated intellectual property rights remain the sole property of Calm Nights.

Customers are expressly prohibited from redistributing, selling, or reproducing any part of the course content or associated digital products for commercial purposes. This includes, but is not limited to, sharing access with non-paying individuals, reselling the course or its contents, or using the materials to create derivative products for commercial gain. 

Any unauthorised reproduction, distribution, or use of these materials beyond the scope of personal access granted through course purchase is strictly prohibited and may result in legal action, immediate termination of access, and potential legal consequences. Calm Nights reserves all rights not expressly granted to customers in these terms and conditions.

Liability

Calm Nights, while committed to providing services, expressly disclaims liability for any direct, indirect, consequential, or incidental damages arising from participation in the 'Connected Sleep System'. This includes, but is not limited to, any losses, injuries, or complications that may occur as a result of implementing the strategies or advice provided in the course. While we strive to offer safe and effective sleep solutions, individual results may vary, and participants acknowledge that they are using the course content at their own risk.

Medical

The ‘Connected Sleep System’ does not take into account medical advice. The advice you receive from us is for informational purposes only and is intended for use with common early childhood sleep issues that are wholly unrelated to medical conditions.

Our advice is NOT intended to be a substitute for medical advice or treatment.  Always seek the advice of your doctor or other qualified health practitioner regarding any matters that may require medical attention or diagnosis, and before following the advice and using the techniques described in the ‘Connected Sleep System’.

Reliance on any information provided by Hayley Laidlow (Calm Nights) is solely at your own risk.

Recording Phone Calls and Zoom Sessions

At Calm Nights, we strive to provide exceptional service to our clients, and to ensure the quality of our interactions, we may record phone calls and Zoom sessions for training, quality assurance, and coaching purposes. These recordings are intended to assist our team in improving our communication and service delivery. If, however, you do not wish for your phone call or Zoom session to be recorded, we kindly ask that you notify Calm Nights in writing at [email protected]. Your privacy and preferences are important to us, and we will respect your request accordingly.

Amendments and Updates

Calm Nights Sleep Consultancy reserves the right to amend these terms and conditions at any time, without prior notice. Any changes will take effect immediately upon being published. We will notify all users of significant amendments via email to the address provided at the time of registration. It is your responsibility to keep your contact information up to date and to review any communications from us regarding changes. Continued use of our programs or platforms following such updates will constitute your acceptance of the revised terms.
